Terms

Terms of service

The terms that apply when you use the MaxPresence app and dashboard.

Effective 2026-10-06

Lire en français

These terms govern the use of MaxPresence. If you are using the app because your employer added you to it, your employer has agreed to these terms and some of them describe their obligations rather than yours.

Who this agreement is with

MaxPresence is provided to organisations. The organisation that subscribes is our customer, and it decides who may use the app, what is recorded, and for how long. If you are an employee of that organisation, your use of the app is governed both by these terms and by whatever your employer's own policies say about attendance.

Accounts

Accounts are created by invitation from an organisation; you cannot sign yourself up. You are responsible for keeping your sign-in details and your phone's screen lock to yourself, because a check in signed by your phone is treated as having been made by you.

Tell your administrator at once if you lose your phone or think someone else can use your account. An administrator can revoke a registered phone, which stops it being able to record attendance.

Using the app properly

You agree not to:

  • Record attendance for anyone other than yourself, or let anyone else use your registered phone to do so.
  • Falsify your location, including by using mock-location tools or a modified build of the app.
  • Attempt to access another organisation's data, or any part of the service you have not been granted.
  • Interfere with the service's operation, or probe it for weaknesses without our written permission.

We may suspend an account that does any of these, and we will tell the organisation's administrator when we do.

Attendance records

Attendance records belong to the organisation, not to us. We store and present them; we do not decide whether a record is correct. If a record is wrong, use the correction request in the app — a manager in your organisation reviews it.

The app is evidence that a check happened at a place and time. It is not, on its own, a determination of hours worked, pay owed, or compliance with employment law. Those remain the organisation's responsibility.

Availability

We aim to keep the service running but do not guarantee it is uninterrupted or error-free. Checking in needs a working network connection and location on your phone; neither is within our control.

The service is provided as it is, without warranties beyond those the law requires and does not allow us to exclude.

Limits on liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, arising from use of the service. Nothing here limits liability that cannot lawfully be limited.

Ending use

You may delete your account at any time from the app, under Profile, or by using the deletion page linked below. An organisation may remove your access at any time. Deleting your account removes who you are but leaves the organisation's attendance records in place with your name taken off, as the privacy policy explains.

Changes and governing law

We may change these terms. Material changes will be notified to organisation administrators before they take effect, and the date above will change.

These terms are governed by the laws of the Republic of Cameroon.

Questions about these documents can be sent to MaxPresence support, published by Maxwell Technologies PLC.

You can delete your account from inside the app under Profile. If you have already uninstalled it, use the deletion page.
